1. Who we are and what this is
These Terms & Conditions (the "Terms") govern your use of Observare, a bundled ops-monitoring service operated from the United Kingdom by a UK sole trader ("we", "us", "Observare").
The marketing website is observare.co.uk. The application, API, and customer control panel are at observare.io. These Terms cover both.
By signing up for an account or using the service, you agree to these Terms. If you do not agree, do not use the service.
2. The service
Observare provides online monitoring tools including uptime checks, SSL certificate expiry monitoring, cron job heartbeats, Stripe webhook logging, and public status pages. Features may change over time as we improve the product.
We will make reasonable efforts to keep the service available and functioning, but we do not guarantee uninterrupted availability (see §9).
3. Your account
Eligibility
You must be at least 18 years old and legally able to enter a contract to use Observare. By signing up, you confirm that you are.
Account security
You are responsible for keeping your password secure and for everything that happens under your account. Tell us immediately at contact@observare.co.uk if you think your account has been compromised.
Accurate information
You agree to provide accurate signup details and to keep them up to date. Providing false billing or contact details is grounds for termination.
4. Acceptable use
When you use Observare, you agree not to:
- Monitor URLs, endpoints, or services you do not own or have permission to monitor
- Use the service to conduct denial-of-service activity, scraping at scale, or any form of abuse
- Use the service for anything illegal, infringing, defamatory, or harmful to others
- Attempt to break, probe, reverse-engineer, or circumvent the security of the service
- Resell, sublicense, or white-label the service without a written agreement with us
- Use the service in a way that disproportionately consumes resources relative to your subscription tier
We may suspend or terminate accounts that breach this section, with or without notice depending on severity.
5. Subscription, billing & trial
Free trial
New accounts receive a 14-day free trial. No payment card is required to start the trial. Trial accounts are limited to 3 monitors. At the end of the trial, monitoring is paused until you add a payment method; your data is retained.
Pricing
The paid subscription is £5 per month, billed in GBP in advance. Prices may change; if we change pricing for your plan, we will give you at least 30 days' notice by email.
Payment
Payments are processed by Stripe. By subscribing, you authorise Observare to charge your payment method each billing period until you cancel. If a payment fails, we will retry, and if it continues to fail we may suspend or terminate your account.
Cancellation
You can cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Your account remains active until then and you retain access to your data.
Refunds
We do not offer pro-rata refunds for partial months. If you believe you have been billed incorrectly, email contact@observare.co.uk within 30 days and we will investigate and correct genuine billing errors.
Taxes
Prices are shown exclusive of VAT unless stated otherwise. You are responsible for any taxes applicable in your jurisdiction that are not collected by us.
6. Your data and content
You own the data you put into Observare, including the URLs you monitor, the cron heartbeat identifiers you create, and any content shown on your status pages.
You grant us a limited licence to process that data solely to provide the service to you. We will not sell your data or use it for purposes unrelated to running the service.
Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.
7. Our intellectual property
The Observare name, logo, software, design, documentation, and all associated intellectual property belong to us. We grant you a limited, non-exclusive, non-transferable licence to use the service for its intended purpose during your subscription.
You may not copy, modify, distribute, or create derivative works from the service without our written permission.
8. Status pages and public content
If you publish a public status page using Observare, you are responsible for the content you display. You agree not to publish content that is illegal, infringing, defamatory, or deceptive to your visitors.
9. Service availability
We aim to keep the service available at all times and we monitor our own infrastructure continuously. However, we do not offer a formal Service Level Agreement (SLA) or uptime guarantee at this tier.
We may perform planned maintenance that briefly interrupts the service. We will try to give notice of planned maintenance in advance.
10. Warranty disclaimer
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
You are responsible for deciding whether the service is suitable for your needs. Observare is a monitoring tool; it reports on the things you ask it to watch, but it cannot prevent outages, certificate expiry, or failed cron jobs — you are responsible for acting on the alerts we send you.
11. Limitation of liability
To the fullest extent permitted by law:
- We will not be liable for indirect, incidental, consequential, special, or punitive damages of any kind
- We will not be liable for loss of profits, revenue, data, business, goodwill, or anticipated savings
- Our total liability to you for any claim arising out of these Terms is limited to the amount you have paid to Observare in the 12 months before the event giving rise to the claim
Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot be limited under UK law.
12. Indemnity
You agree to indemnify and hold Observare harmless from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the service, or your violation of any law or third-party right.
13. Termination
You can terminate your account at any time by cancelling your subscription and deleting your account.
We may suspend or terminate your access if you breach these Terms, fail to pay, or use the service in a way that threatens its integrity or that of other users. Where practical we will give notice; in serious cases we may act immediately.
On termination, your subscription ends, your monitors stop, and we will delete your data in line with the retention periods in our Privacy Policy.
14. Changes to these Terms
We may change these Terms from time to time. If we make material changes, we will tell you by email and update the "last updated" date at the top. Small clarifications may be made without notice. Continuing to use the service after changes take effect means you accept the new Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of England & Wales. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of England & Wales.
